Explica el abogado Pertierra que “aunque la fecha de prioridad para las solicitudes basadas en una certificación laboral esté disponible, eso no implica que el solicitante reciba de inmediato una visa de residencia permanente”.
“El total de visas disponibles para cada año fiscal se distribuye por país en base a porcentajes equitativos y cada nación puede recibir hasta un máximo total de 20 mil, pero eso depende también del promedio de visas que se le han otorgado anualmente a lo largo de la historia”, agrega.
Pertierra reiteró además que “las fechas que aparecen en el Boletín de Visas indica el mes y el año que el USCIS está viendo las solicitudes de residencia presentadas por medio del Formulario I-130 o la certificación laboral”.
“Pero si un país agota antes del término del año fiscal la cuota asignada, se detiene el proceso hasta el siguiente año fiscal”, finalizó.
El año fiscal en Estados Unidos comienza el 1 de octubre y finaliza el último día del mes de septiembre del año siguiente.
